The first this year meeting of the Working Group on Air Protection and Energy operating within the national network of environmental authorities and managing authorities of EU funds “Partnership: Environment for Development” was held on February 25, 2019 in Warsaw.
The subject of the meeting were the legislative plans of the Ministry of the Environment, relating to the adaptation of national law to the decision of the Court of Justice of the European Union C-336/16, on the violation of the obligations laid down in the Directive 2008/50/EC (air quality status). According to the above-mentioned decision, Poland was obliged to, inter alia: increase the efficiency of Air Protection Programmes (hereinafter referred to as APP); establish an obligation to include in APP elements allowing to assess the correctness, efficiency and effectiveness of corrective measures taken; establish uniform standards for drawing up APP – in particular, to determine the methodology for designating emission volumes, including the rules for calculating ecological effects achieved as a result of corrective measures taken, and to carry out their regular and systematic analysis at the regional level and the degree of implementing the objectives of individual APP.
Based on these recommendations, the Ministry of the Environment prepared a draft amendment to the Act of 27 April 2001 – Environmental Law, along with a draft regulation on APP and short-term action plans.
The meeting was aimed at presenting persons from the marshal’s offices, responsible for creating APP, with solutions adopted during ministerial work and related requirements.
In addition, the findings of the meeting will be used by the Ministry to modify the prepared provisions, mainly those included in the Regulation, in accordance with the submitted observations and noticed interpretative problems.
